FINALNOTICE AND PUBLIC EXPLANATION OFAPROPOSED ACTIVITY IN A100-YEAR FLOODPLAIN Date of publication: August 7, 2019 To: All Interested Agencies, Groups, & Individuals This is to give notice that the Shannon County has conducted an evaluation as required by Executive Order 11988 for floodplain management,, in accordance with HUD regulations at 24 CFR 55.20 Subpart C Procedures for Making Determinations on Floodplain Management, to determine the potential affect that its activity in the floodplain and/or wetland will have on the human environment for Community Development Block Grant under Title I of the Housing and Community Development Act of 1974 (PL 93-383). Shannon County seeks to implement a transportation improvement project in Birch Tree to replace the surfaces of crossings of Birch Creek at Spruce Street, Jayson Street, and Main Street. Additionally, the project seeks to provide a resurfacing overlay on “Old Highway 60” approximately 2.1 miles in length. The particular portion of Main Street on which the project will take place contains 0.02 acres of land within the FEMA regulatory floodplain. This is the only section of the project located within a floodplain. Floodplains have natural value and serve a number of beneficial purposes, some include: flood water storage and conveyance, erosion control, and habitat for native flora and fauna. Shannon County has considered the following alternatives to building in the floodplain and has determined that it has no practicable alternative: (1) no improvement at the Main Street Crossing, (2) construct detention basins outside of the FEMA regulatory floodplain. The improvement at Main Street must be located within floodplain due to the elevation of the existing crossing at Birch Creek. Environmental files that document compliance with steps 3 through 6 of Executive Order 11988 for floodplain management, are available for public inspection, review and copying upon request at the times and location delineated in the last paragraph of this notice for receipt of comments. This activity will have no significant impact on the environment for the following reason: the construction taking place in order to replace the surface of the Main Street crossing will occur within the existing footprint of the developed roadway and no construction activities will take place within the stream bed of Birch Creek. There are three primary purposes for this notice. First, people who may be affected by activities in floodplains and those who have an interest in the protection of the natural environment should be given an opportunity to express their concerns and provide information about these areas. Second, an adequate public notice program can be an important public educational tool. The dissemination of information floodplains can facilitate and enhance Federal efforts to reduce the risks associated with the occupancy and modification of these special areas. Third, as a matter of fairness, when the Federal government determines it will participate in actions taking place floodplains, it must inform those who may be put at greater or continued risk. Written comments must be received Shannon County at the following address on or before August 14, 2019: 18529 Main Street, Eminence, MO 65466; (573)226-3965, Attention: Jeff Cowen, Presiding Commissioner. Comments may also be submitted or further information can be requested via email at Shannon.County@sos.mo.gov. Afull description of the project may also be reviewed from 9 am – 3 pm at Shannon County Courthouse. Jeff Cowen, Presiding Commissioner
